What is an EB-5?

Since its introduction in 1990 by the U.S. Immigration Act, the EB-5 program provides a special category of immigration visa for the high-net-worth international investor. After the successful completion of the program, investors and their family members (spouse and unmarried children under the age of 21) are given a conditional resident status in the United States, which can be converted into a permanent residency with a path to citizenship

Who is eligible to apply for a EB-5?

International investors and their family members spouse and unmarried children under the age of 21 who are also considered to be accredited investors. Applicants must invest the required amount in the United States, prove that they earned their money legally, as well as satisfy some general requirements.

Who is considered an accredited investor?

To be considered an EB-5 investor a person must either 1. have an annual income over $200,000, or over $300,000 joined with a spouse, for both of the two preceding years; or 2. have a net worth of over $1 million, alone or joined with a spouse.

What is the application process like?

After the approval of the initial application, which is focused primarily on establishing the legal source of the investment of $500,000 (known as an I-526 Petition), the applicant and his or her immediate family are eligible for a conditional resident status in the United States. Once the applicant establishes that the investment of $500,000 was made in the selected project and the 10 full-time jobs were created within the required period (or will be created within a reasonable time period), the condition attached to the visa is removed and the applicant and family receive permanent resident status in the United States.

What is the required investment amount in the EB-5 program?

In order to qualify for an investment in a targeted employment area encompasses the majority of regional center projects, the minimum investment is equal to $500,000. When investing in any other area, the minimum requirement is $1 million.

How many jobs needs to be created in order for an investor to obtain a Green Card?

The project must create at least 10 jobs in order to be eligible for a Green Card.

What is the difference between conditional vs. permanent residency status?

Once an investor will be approved, they will be considered conditional residents for a 2-year period. The investor will have 90 days right before they have had their conditional residency for 2 years to file a I-829 to become a permanent resident. If USCIS approves the application, the conditional status will be removed and the individual will be granted a permanent residency status.

What are the requirements to eventually gain permanent residency status?

The project invested in must be sustained and the 10 required jobs must have been created as a result of the investor’s project.
